  • Conduct of a compliance verification procedure by NIC Monaco
  • Court decision ordering the freezing of the domain name

The freezing of a domain name may result in the cancellation of any operation in progress and the impossibility of any operation on all the domain names in the holder's portfolio. The holder's domain name(s) remain functional during the freeze procedure

Registrations can be rejected on the basis of:

  • The domain name has already been the subject of a registration request or already exists at the time of the registration request;
  • The domain name does not comply with the entries made on the supporting documents;
  • The domain name is likely to infringe or harm:
  • Public order, good morals.
  • To rights guaranteed by the Constitution or by the law and regulations in force; o the image or values of the Principality of Monaco.

  • The request is not sent through a Registrar approved by NIC Monaco;
  • The application is incomplete or contains errors or anomalies.

NIC Monaco reserves the right to request any documents or supporting documents it deems necessary.

When the examination of the request is satisfactory, NIC Monaco sends by all means to the Registrar the authorization allowing it to proceed with the registration of the domain name.

In the event of a dispute, article 7.2 "Resolution of disputes" will be applied.

Furthermore, NIC Monaco reserves the right to refuse any request whose terms could cause confusion with the missions or identity of the Government of Monaco and the institutions of the Principality.

Registry can force transfer domains:

  • The NIC Monaco proceeds to the forced transmission (without the agreement of the holder) of domain names in the following cases:
  • The holder no longer meets the requirements of the Charter concerning this domain name when a new holder who requests it has the capacity to do so (e.g. sale of activity, takeover of a company, etc.);
  • The holder carries out an asset transaction when the original holder no longer has the capacity to carry out a voluntary transfer;
  • The holder no longer has a legal existence (e.g. cessation of activity) and a new holder has the legitimate rights to obtain this domain name;a court decision ordering the forced transmission of the domain name.
  • The forced domain name transmission procedure implies that the new holder proceeds, through a Registrar, to all the necessary steps with NIC Monaco and submits to the rules (in particular identification, eligibility) mentioned in the Charter.
  • In general, the forced transmission can only become effective subject to compliance with the terms of the Charter by - The new owner. The Monaco NIC may, as necessary, carry out the checks it deems necessary and request the communication of the necessary information.
  • All the costs, in particular technical and administrative costs, related to a forced transmission, are the responsibility of the new holder who, if necessary, takes care of their possible recovery from the former holder.

Domains can be deleted on the basis of:

  • No more legal existence of the holder for at least 2 years.
  • Inactive domain name over the same period.
  • No notification to NIC Monaco of any transfer of the domain name over the past two years.
